Are Arrest Records Public Information in Larimer, Colorado?

Yes, according to the Colorado Criminal Justice Records Act (CCJRA), arrest records are public records in Larimer County and other Colorado counties. The Colorado Open Records Act (CORA) further governs which records are classified as public records, how they are made available to the public, and exemptions to public disclosure for public privacy and safety. Law enforcement agencies like the Larimer County Sheriff’s Office manage these arrest records and may have specific requirements for accessing arrest records, but generally, individuals may need a valid form of ID to access arrest records, especially in person or by mail. One does not need to be a resident of Larimer County to request a record. Record requests may come with a fee or be free for basic searches, depending on the law enforcement agency from which the record is being requested. 

What Do Public County Arrest Records Contain?

Depending on the arresting agency, arrest records at the state and federal levels are maintained by different law enforcement agencies. According to Colorado law, each agency maintains and disseminates its records per its own requirements, fees, and access structure. These agencies are as follows:

  • State: The Colorado Bureau of Investigation (CBI) provides a name-based Internet Criminal History Search tool for statewide criminal history information. Searches attract a fee, and their results exclude records from agencies that do not report in real time and sealed or expunged records. The Colorado Department of Corrections (CDOC) also provides an offender search tool for finding arrest records on inmates incarcerated in state prisons. A search can be completed using the name of the arrestee or their DOC number. The offender search tools show results for state prisons only, not individuals arrested in counties.
  • Federal: The Federal Bureau of Investigation oversees federal arrest records. Individuals can request an Identity History Summary for access to these arrest records. This is a paid fingerprint-based national background check tool (it costs $18) that shows arrests made public by the FBI. Not all federal arrests are reported by this tool. They are useful for quick lookups but do not provide full arrest reports or previous arrest histories. Active Warrant Search in Larimer County

An arrest warrant in Larimer County is a judge-issued order for a law enforcement officer to take a person into custody when they are suspected of committing a crime. Arrest warrants are issued by a court during an investigation when probable cause is established that the crime was indeed committed by the suspect. Arrest warrants are executed by the Larimer County Sheriff’s Office, which serves as the primary law enforcement agency in the county and manages arrest warrant records. They have an online Most Wanted registry that lists individuals to be arrested who may also have a warrant issued for their arrest.

  • A public arrest warrant in Larimer County typically contains the following information:
  • The name of the individual to be arrested
  • Reason for the arrest

How to Find Arrest Records for Free in Larimer County

Yes, there are free resources for finding free arrest records in Larimer County, but the only arrest information that can be retrieved is booking information and custody information. Full police reports and historic arrest records are restricted to a mail or in-person record request. The free options are as follows:

  • Sheriff's Office Booking Report: It shows arrest information like the name of the arrestee, custody status, etc., which is updated daily. A free lookup can be carried out using a first name or a last name. This tool, however, only covers recent arrests and does not provide narrative arrest records or arrest histories. 
  • Larimer County Jail Inmate Search: The inmate search tool is a live tool that gives arrest information on individuals currently incarcerated in or previously released from the Larimer County Jail.

Larimer County also has an Incident blotter where basic arrest details can be obtained on an arrest. Third-party lookup tools are also available online for a free lookup of arrest records. Free lookup tools are limited by the scope of their results, their access to redacted information, and the details they provide, but they do not need an ID to be accessed. To request older records, individuals need to make a formal request to the sheriff's office. and may likely be required to pay fees.

Larimer County Arrest Report

Although used interchangeably, arrest reports differ from arrest records. A Larimer County arrest report is a document created by the arresting law enforcement officer during the arrest to summarize his/her account of the incident and the circumstances leading to the arrest. Arrest reports typically contain the reason for the arrest, probable cause justifying the arrest, witness accounts, the officer's observations, and recommendations. Arrest reports are maintained by the Larimer County Sheriff’s Office Records Department and the municipal police department that made the arrest. Arrest records, on the other hand, are official documentation of an arrest that is entered into the county's case management system. It is an administrative entry recording that an arrest occurred and the charges that resulted from the arrest.

How to Get an Arrest Record Expunged in Larimer County

Expunction is the legal process of removing a court record from unauthorized public view. In Colorado, only juvenile records can be fully expunged when eligibility requirements are met. Adult arrest records can only be sealed under the law. 

  • The requirements for a record to be eligible for sealing or expunging are as follows:
  • The arrest case was dismissed
  • The arrestee was acquitted of the charge
  • The arrestee completed a diversion program
  • The sentence was served, or the arrestee received a deferred judgment
  • The case was not judged a delinquent act (expungement)

The steps for expunging or sealing a record are as follows:

  • The individual confirms the eligibility of their arrest record for sealing or expungement
  • A petition for expungement of records form is filed (JDF 477 or JDF 304) with the Larimer County District Court or the Larimer County Juvenile Court (expungement)
  • Pay the applicable fees for expunction ($65 for sealing, often free for juvenile expunction) or get the fee waived if indigent.
  • Individuals may be required to attend court hearings to further defend their petition before a judge.
  • If granted, the court expunges or seals the record and issues an order. The individual mails copies of the expunction order to the Colorado Bureau of Investigation and those agencies listed on the Order to ensure that their records are sealed 

How Do You Remove Larimer County Arrest Records From the Internet?

Larimer County arrest records can be effectively removed from the internet by petitioning the court for removal through the expunction or sealing of the record according to the Colorado Criminal Justice Records Act (CCJRA).

  • Sealing: C.R.S. § 24-72-701 et seq. governs how records are sealed in Colorado. For an arrest record to be eligible for expunction, it should not have led to a conviction. The charges may have been dismissed. acquitted, or the individual may have completed a diversion program. To seal a record, a petition to seal criminal justice records is filed with the Larimer County District Court, and once granted, the record is sealed from the public database search but may still be available to law enforcement agencies.
  • Expunction: Expunction can be used for removing public access to juvenile records under C.R.S. § 19-1-306. Individuals can file for expunction through the Larimer County Juvenile Court to permanently remove the record from public view. Not all adult convictions can be fully expunged in Colorado, but some can be expunged after the satisfaction of the required waiting period.

After the petition to seal or expunge is granted, the court sends an order to relevant agencies keeping digital or physical copies of the criminal record, including the Colorado Bureau of Investigation (CBI) and the Larimer County Sheriff’s Office Records Department. These bodies honor the order by removing the records from their public databases, making them unavailable online. Third-party databases for arrest records need to be contacted separately with the order to remove court records online, as the court does not send the order to them.
